Our Story

How Berkat Advisory came to be

Berkat Advisory was established in Ipoh with a straightforward intent: to offer family law services that treated clients as people navigating genuinely difficult circumstances, rather than as cases to be processed. The founding practitioners had each worked within larger institutional settings and had observed, repeatedly, how the formality and pace of conventional legal practice could add unnecessary difficulty to situations that were already hard enough.

The chambers opened on Jalan Sultan Iskandar with a small team and a deliberate choice to limit its practice to family law. Not because no other area of law was possible, but because doing one thing well — and doing it with consistent care — seemed more worthwhile than spreading attention thinly. That focus has remained unchanged.

Over time, Berkat Advisory has developed particular depth in situations where both civil and Syariah frameworks are relevant — a not uncommon complexity for families in Malaysia — and in long-term arrangements where a client's circumstances evolve over years rather than resolving in a single proceeding. The team has grown modestly to reflect increased demand, while holding to the chamber's founding character.

Bar Council Membership

All practitioners at Berkat Advisory are members in good standing of the Malaysian Bar, with current practising certificates reviewed annually.

Syariah Court Accreditation

Where matters involve the Syariah judiciary, our team holds the relevant accreditation to appear and advise within Perak Syariah courts.

Client Confidentiality Protocol

We maintain a written confidentiality protocol reviewed bi-annually. Client information is held securely and never disclosed outside the chambers without explicit written authorisation.

Continuing Professional Development

Each practitioner completes annual CPD hours above the Bar Council minimum, with a focus on family law developments and legislative updates in Malaysia.

Mediation Practitioner Accreditation

Senior practitioners hold accreditation from a recognised Malaysian mediation body, enabling them to conduct structured mediation sessions as neutral parties where appropriate.

Personal Data Protection Compliance

All personal data held by the chambers is managed in accordance with the Personal Data Protection Act 2010 (Malaysia), with a designated data handler responsible for compliance.

Family law in Malaysia — what it involves and where we contribute

Family law in Malaysia operates across two distinct legal frameworks — the civil courts under the Law Reform (Marriage and Divorce) Act 1976, and the Syariah courts which govern Muslim family matters under state-level enactments, including the Islamic Family Law (State of Perak) Enactment. The interplay between these two systems is one of the more nuanced areas of Malaysian law, and clients whose circumstances touch both frameworks benefit from practitioners who understand each in practical depth.

Divorce proceedings, regardless of framework, involve a number of subsidiary questions that often carry more day-to-day significance than the divorce itself: the care and custody of children, arrangements for access by the non-custodial parent, the calculation and enforcement of maintenance, and the division of matrimonial assets and jointly-held property. Each of these areas has its own body of case law, procedural requirements, and scope for negotiated resolution.

Mediation has become an increasingly valued approach in family disputes, particularly where children are involved. Court-ordered mediation is now part of many family proceedings, and parties who arrive at mediation with skilled legal preparation are generally better placed to reach outcomes that reflect their actual interests. Berkat Advisory prepares clients thoroughly for mediated processes and works to ensure that any agreement reached is durable and enforceable.
