Frequently asked questions

What happens during the initial family conversation?
The session takes place in a private room at our Ipoh chambers. We will ask you to share the background of your situation at whatever level of detail you are comfortable with. We listen carefully and, where appropriate, ask clarifying questions. At the end of the session, we will provide an initial outline of your options — and within a short period after, you will receive a written note to take away and read in your own time.
Does attending a consultation commit me to any further engagement?
No. An initial consultation is a standalone session. You are under no obligation to proceed further, and we do not expect any commitment before you have had adequate time to consider the options presented. Should you wish to proceed, we will discuss the most appropriate engagement structure with you at that point.
Can you assist with both civil and Syariah family matters?
Yes. Berkat Advisory works across both civil and Syariah jurisdictions as they apply to family law in Malaysia. Some client situations involve both frameworks — for instance, where one spouse is Muslim and the other is not, or where property and custody fall under different authorities. We will identify the applicable framework clearly during the initial session.
How long do family law proceedings typically take in Malaysia?
Timelines vary considerably depending on the complexity of the matter, whether both parties are cooperative, and the court calendar at the relevant time. Uncontested divorces with agreed terms may be concluded within several months. Contested matters involving custody disputes or complex asset division may take considerably longer. We will give you a realistic time estimate once we understand your specific circumstances.
What information should I bring to a first appointment?
It is helpful — though not required — to bring any relevant documents you have readily to hand, such as a marriage certificate, any existing court orders, or documentation relating to shared assets. If you have nothing prepared, do not let that prevent you from attending. We can work with information provided verbally and advise you on what documentation may be needed later.
Is mediation a realistic option, and when is it appropriate?
Mediation can be a genuinely useful path when both parties are prepared to participate in good faith and where communication has not broken down entirely. It tends to be less costly and less time-consuming than contested court proceedings, and it allows both parties more control over the outcome. We will advise you honestly on whether mediation appears suitable in your situation, and prepare you thoroughly if you choose that route.
What does the Family Stewardship Retainer cover?
The retainer is designed for clients whose family circumstances are ongoing or evolving — such as those with blended families, international connections, or circumstances where custody and maintenance arrangements may need to be revisited over time. It includes scheduled review meetings, access to consultation throughout the year, drafting of relevant documents as needed, and standing representation if proceedings arise. We do not bind retainer clients to unnecessary activity — reviews only occur when they are of genuine value.
